1. Acceptance of these Terms

These Terms govern your access to and use of Probapedia. By creating an account, subscribing, purchasing a top-up or day pass, or otherwise using the service, you agree to these Terms. If you do not agree, do not use the service.

2. The service

Probapedia is an AI-assisted trading-education engine. It teaches a probability mindset, risk concepts, statistical reasoning, and chart-reading fundamentals. It does not predict markets. It does not issue buy or sell calls. It does not execute trades. It is not a broker, dealer, exchange, investment adviser, portfolio manager, or fiduciary. No output from Probapedia is financial, investment, tax, or legal advice.

3. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract in your jurisdiction. You must not be barred from receiving financial education services under the laws that apply to you. Probapedia is not directed at anyone under 18.

4. No financial advice and no predictions

All output is educational analysis. Any probability range you see is conditional on the setup, sample size, market regime, risk-reward ratio, and period you provide. Past data does not predict future outcomes. You decide on your own responsibility. You are solely responsible for any decision you make, any order you place, and any outcome that follows. Probapedia has no stake in the outcome of your trades.

5. Your account

6. Acceptable use

You agree not to:

7. Subscriptions, top-ups, day passes

Subscription credits reset monthly on the billing anniversary. Top-up credits never expire. Daily usage limits apply by tier. Credit balances are non-transferable. Credit balances are non-refundable except as stated in the Refund Policy. Pricing and tier features may change; a paid billing period is honoured at the price paid for that period.

8. Payments and billing

Payments are handled by an independent payment processor. Card data never reaches Probapedia. You authorise recurring charges for the subscription tier you select until you cancel. You may cancel at any time; cancellation takes effect at the end of the current billing period. Taxes are applied as required by law.

9. Cancellation and termination

You may cancel your subscription at any time from your account or through the payment processor. We may suspend or terminate your access for material breach of these Terms, for fraud, for illegal activity, for non-payment, or where required by law. On termination for breach, unused credits are forfeited except where the Refund Policy provides otherwise.

10. Availability and changes to the service

The service is provided on a best-effort basis. We may change features, analytical engines, providers, or pricing. We may perform maintenance that interrupts the service. We do not guarantee uninterrupted or error-free operation.

11. Intellectual property

The Probapedia name, interface, prompts, code, documentation, and design elements belong to Probapedia and its licensors. You retain ownership of the messages and files you submit. You grant Probapedia a limited, non-exclusive licence to process your messages and files solely to deliver the service, to enforce these Terms, and to comply with law. That licence ends when the data is deleted under the Privacy Policy.

12. Third-party services

Probapedia relies on independent service providers for hosting, authentication, analytical processing, payment, email delivery, and security. Their outages, terms, or decisions may affect the service. Probapedia is not responsible for third-party sites you reach through links. Read their terms before using them.

13. Disclaimers

The service is provided "as is" and "as available". To the maximum extent permitted by law, Probapedia disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. Automated output may contain errors. Verify before relying on it.

14. Limitation of liability

To the maximum extent permitted by law, Probapedia is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, nor for lost profits, lost trading capital, lost opportunities, or lost data. Our total liability for any claim arising out of these Terms or the service is limited to the amount you paid Probapedia in the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnity

You agree to indemnify and hold Probapedia harmless from any claim, loss, or expense arising out of your use of the service, the content you submit, or your violation of these Terms, except to the extent caused by Probapedia's own negligence or wilful misconduct.

16. Force majeure

Neither party is liable for failure to perform caused by events beyond its reasonable control, including network failures, provider outages, natural disasters, or regulatory action.

17. Governing law and disputes

These Terms are governed by the laws of the European Union, without regard to conflict-of-laws rules. Before any formal claim, contact the address in section 20 and allow 30 days for a good-faith resolution. Consumers retain any statutory rights available in their country of residence.

18. Changes to these Terms

We may update these Terms. When we do, we update the date at the top. Material changes are announced in the application at least 14 days before they take effect. Continued use after the effective date means you accept the revised Terms.

19. Severability and entire agreement

If a provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, the Refund Policy, the Cookie Policy, and the Data Processing Agreement, form the entire agreement between you and Probapedia regarding the service.
